TERMS OF SALE — ELYANA & CO

Article 1 — Nature of the business and origin of products
Elyana & Co operates an online sales activity based on the dropshipping model. The products offered for sale are manufactured and shipped directly from suppliers and warehouses located in China. Elyana & Co is not involved in manufacturing or physically storing the products, and acts as a commercial intermediary between the customer and the supplier.
This information is brought to the customer's attention before any order is confirmed, in accordance with pre-contractual information requirements.
Article 2 — Prices
Product prices are shown in euros, all taxes included. Elyana & Co reserves the right to change its prices at any time, it being understood that the price applicable to an order is the one in effect at the time the order is confirmed.
Article 3 — Orders
The customer confirms their order after checking the contents of their cart, the total price, and the delivery terms. Order confirmation constitutes acceptance of these Terms of Sale. A confirmation email is sent to the customer once payment has been validated.
Article 4 — Payment
Payment is due immediately upon ordering. Payments are processed via Shopify Payments, ensuring a secure and encrypted transaction.
Article 5 — Delivery and timeframes
Because products are shipped from China, delivery times are longer than those typically seen for products stored in Europe. The estimated delivery time is 5 to 7 business days, excluding order processing time. This timeframe is provided as an estimate and may vary depending on customs, the carrier, and the time of year.
The customer is informed of these timeframes before confirming their order. Elyana & Co cannot be held liable for delays caused by the carrier or customs procedures.
Article 6 — Returns and exchanges
Products must be returned in their original condition, unworn, unwashed, and with their original tags. Return shipping costs are the customer's responsibility, except in the case of a defective product or one that does not match the order.
Article 7 — Legal warranties
All products sold are covered by the legal warranty of conformity and the legal warranty against hidden defects, independent of any commercial warranty that may apply.
Article 8 — Liability
Elyana & Co cannot be held liable for damages resulting from misuse of a purchased product, nor for delays related to international shipping. Elyana & Co's liability cannot be engaged in the event of non-performance or improper performance of the contract due to the customer's own actions, the unforeseeable act of a third party, or a case of force majeure.
Article 9 — Personal data
Personal data collected during the ordering process is processed in accordance with the site's privacy policy, available at [link to privacy policy], and in compliance with the General Data Protection Regulation (GDPR).
Article 10 — Intellectual property
All content on the site (text, images, logos) is protected by intellectual property law and remains the exclusive property of Elyana & Co or its partners.
Article 11 — Governing law and disputes
These Terms of Sale are governed by French law. In the event of a dispute, the customer may pursue conventional mediation or any other alternative dispute resolution method. Failing an amicable resolution, French courts shall have sole jurisdiction.
